Officers testify Rock Island man naked, bloody when arrested

Multiple officers were needed to subdue Dustin J. Dailey, naked and covered in blood, the morning he allegedly sexually assaulted a 78-year-old Rock Island woman last year, according to testimony Tuesday.

Charged with one count of home invasion and two counts of aggravated criminal sexual assault, Mr. Dailey, 27, of Rock Island, began abench trial Tuesday before Rock Island County Circuit Court Judge Walter Braud. He was arrested July 28, 2011.

On May 17, Mr. Dailey pleaded guilty to the home invasion charge and one count of aggravated criminal sexual assault. After medical testimony indicated Mr. Dailey may have been under the influence of synthetic drugs, he was allowed to withdraw that plea in favor of a bench trial.

According to previous testimony, Mr. Dailey told police that, on the evening of July 27, 2011, he smoked marijuana with a friend in Bettendorf before traveling to his sister's Rock Island apartment. There, Mr. Dailey reportedly shed his clothing and ran about before leaving the building.

On Tuesday, a now 80-year-old Rock Island woman testified that, later that night, she was alone in her home in the 3200 block of 26th Street when she woke to loud banging on her front door. She said she grabbed her late husband's rifle from her bedroom closet and went to her living room, only to hear her bedroom window break.

Moments later, Mr. Dailey, naked, came into the room, she said. When he refused to stop walking toward her, the woman said she pulled the gun's trigger twice. When the gun failed to fire, Mr. Dailey yanked it from her hand and pushed her head towards his genitals, the victim said.

He also bit her through her pajamas and pushed her to the floor while muttering incoherently, the woman testified. She said Mr. Dailey stopped his attack only after she told him she was a grandmother.

The woman said Mr. Dailey later asked her to make a phone call for him, but she was shaking too much. Instead, she said, she opened her front door and Mr. Dailey fled.

Also on Tuesday, a couple living in the same block testified that, less than 15 minutes later, they were on their back porch when they saw a naked man run across a neighbor's yard and leap over a 6-foot fence into their property.

The man, later identified as Mr. Dailey, ran toward them, grabbed the woman's arm and wrestled with the man, the couple testified. The man eventually pinned Mr. Dailey to the ground until police arrived.

Mr. Dailey was so bloody that officers had difficulty handcuffing him, testified Rock Island Police Officer Jonathan Shappard. Multiple officers testified Tuesday that, throughout his interaction with officers, Mr. Dailey shifted his behavior from aggressive with incoherent statements to calm and coherent.

"He seemed to have an almost unnatural kind of strength," said officer Eduardo Starks.

Officer Tony Zier testified that, at the scene, Mr. Dailey told police he was on meth, PCP, ecstasy, heroin and marijuana. A later toxicology report, however, suggested he only had marijuana in his system.

In a police interview the morning of his arrest, Mr. Dailey said he had tried to have sex with the victim, Detective Greg Whitcomb testified.Transcripts of the interview were made, although the audio recording of it apparently was mistakenly destroyed, the detective said Tuesday.

Police also testified that the victim was treated for multiple bruises and wounds, and that a gun and multiple blood stains were found in her residence.

The prosecution is expected to rest their case this morning, at which point the defense will be allowed to begin presenting evidence.
