Islamic group sues DuPage County over facility
Comment on this story
CHICAGO (AP) — An Islamic group has filed a lawsuit against DuPage County seeking unspecified monetary damages for the county board's refusal to allow an education facility to operate near Naperville.
In a ruling last week, U.S. District Court Judge Rebecca Pallmeyer reversed the board's decision barring the Irshad Learning Center.
The board in 2010 denied a conditional-use permit for the facility, claiming concern about the center operating in a residential neighborhood.
Pallmeyer found the county board made an 'arbitrary and capricious' decision by denying a conditional-use permit for the Irshad Learning Center.
Kevin Vodak of the Chicago chapter of the Council on American-Islamic Relations says the center is seeking 'appropriate compensation' to pay for the group's legal fees and expenses.
DuPage County officials have declined comment on the lawsuit.
